Diagno Terms of Use

DIAGNO TERMS OF USE

These Terms of Use (“Terms”) govern your access to and use of the Diagno mobile application and related services (collectively, the “Services”).

The Services are operated by Khalil Pady, doing business as Diagno (“Diagno,” “we,” “us,” or “our”).

Please read these Terms carefully.

BY CREATING AN ACCOUNT, EXPRESSLY ACCEPTING THESE TERMS IN THE APP, OR USING DIAGNO AFTER BEING PRESENTED WITH THESE TERMS, YOU AGREE TO BE BOUND BY THEM.

If you do not agree, do not use the Services.

1. ELIGIBILITY

Diagno is intended only for individuals who are at least 18 years old.

By creating an account or using the Services, you represent that:

  • you are at least 18 years old;
  • you have the legal capacity to enter into these Terms; and
  • the information you provide is accurate to the best of your knowledge.

You may not create or use a Diagno account if you are under 18.

2. IMPORTANT AUTOMOTIVE AND AI SAFETY NOTICE

Diagno is an artificial-intelligence software service.

Diagno is not:

  • a physical vehicle inspection;
  • a licensed or certified automotive repair facility;
  • a human mechanic;
  • an ASE-certified mechanic;
  • a safety inspection;
  • a roadworthiness certification;
  • an emergency service;
  • an insurance appraisal;
  • a repair estimate or binding repair quote; or
  • a guarantee regarding the condition of any vehicle.

Diagno cannot physically inspect your vehicle and cannot observe every condition that may affect its operation or safety.

AI-generated results can be incomplete, inaccurate, outdated, misleading, or wrong.

You should not rely on Diagno as the sole source of information when making decisions concerning vehicle safety, maintenance, diagnosis, or repair.

3. AI-GENERATED DIAGNOSES

Diagno may analyze information such as:

  • vehicle sound recordings;
  • vehicle year, make, model, and mileage;
  • descriptions you provide;
  • warning lights;
  • operating conditions;
  • symptom answers; and
  • related diagnostic information.

Based on those inputs, Diagno may generate a likely issue, explanation, confidence information, severity, driving guidance, repair-cost estimate, recommendations, or follow-up questions.

These outputs are AI-generated assessments based on limited information.

They are not guaranteed diagnoses.

The actual cause of a vehicle problem may differ from Diagno's assessment, including because:

  • audio recordings may be unclear;
  • multiple vehicle failures may sound similar;
  • information supplied by the user may be incomplete or inaccurate;
  • a condition may not be detectable through sound;
  • a vehicle may have multiple simultaneous problems;
  • important physical conditions may not be visible to Diagno; or
  • artificial-intelligence systems may make errors.

A qualified automotive professional performing a physical inspection may reach a different conclusion.

4. DRIVING GUIDANCE DOES NOT CERTIFY VEHICLE SAFETY

Diagno may provide Driving Guidance based on the information available to the Service.

Driving Guidance is informational only.

Diagno does not certify that a vehicle is safe, roadworthy, legally compliant, or suitable to operate.

A result such as: “No immediate concern identified”

means only that Diagno did not identify an immediate concern from the limited information analyzed.

It does not mean:

  • that no dangerous condition exists;
  • that all vehicle systems were inspected;
  • that the vehicle is guaranteed safe;
  • that continued driving cannot result in failure, damage, injury, or death; or
  • that a professional inspection is unnecessary.

If you experience symptoms suggesting a potentially serious safety condition— including problems involving braking, steering, tires, suspension, wheels or lug hardware, fuel leakage, smoke, fire, severe overheating, airbags, severe fluid loss, or loss of vehicle control—you should stop operating the vehicle when it is safe to do so and seek appropriate professional or emergency assistance.

5. AI CONFIDENCE INFORMATION

Diagno may display confidence information regarding an AI-generated assessment.

Unless expressly stated otherwise, such confidence information represents the AI system's assessment based on available inputs.

It does not represent:

  • a guarantee of correctness;
  • a warranty;
  • a certified diagnostic probability;
  • independently verified diagnostic accuracy; or
  • proof that another cause is impossible.

Do not interpret a confidence percentage or confidence label as certainty.

6. REPAIR-COST ESTIMATES

Diagno may provide estimated repair-cost ranges.

These are general informational estimates only.

Actual repair costs may vary based on factors including:

  • geographic location;
  • labor rates;
  • vehicle configuration;
  • parts availability;
  • OEM versus aftermarket components;
  • taxes and fees;
  • additional damage;
  • diagnostic labor; and
  • the actual underlying problem.

A Diagno cost estimate is not a quote, offer, contract, warranty, or guarantee of repair cost.

You should obtain an actual estimate from a qualified repair provider before authorizing work.

7. AI MECHANIC

“AI Mechanic” is the name of an artificial-intelligence software feature within Diagno.

AI Mechanic is not a human mechanic and is not a licensed, certified, or credentialed automotive professional.

Responses generated through AI Mechanic may contain mistakes.

AI Mechanic may provide explanations, troubleshooting information, maintenance information, or general repair guidance, but such information does not replace an appropriate professional inspection or professional judgment.

8. REPAIRS AND DO-IT-YOURSELF ACTIVITIES

Automotive maintenance and repair can involve serious hazards, including:

  • elevated vehicles;
  • high temperatures;
  • pressurized systems;
  • electricity;
  • batteries;
  • fuel;
  • chemicals;
  • moving components;
  • heavy parts;
  • airbags;
  • braking systems; and
  • other safety-critical systems.

You are responsible for determining whether you have the knowledge, training, equipment, environment, and physical ability necessary to perform any procedure.

Do not perform a repair or inspection you are not qualified to perform.

Diagno does not guarantee that repair instructions, procedures, specifications, or recommendations generated through AI are complete or appropriate for your particular vehicle.

When appropriate, consult the vehicle manufacturer's service information or a qualified automotive professional.

9. USER RESPONSIBILITY

You remain responsible for:

  • deciding whether and when to operate your vehicle;
  • complying with traffic and vehicle-safety laws;
  • maintaining your vehicle;
  • obtaining appropriate professional inspections;
  • deciding whether to perform repairs;
  • verifying important information before acting on it;
  • choosing repair providers;
  • ensuring repairs are completed appropriately; and
  • taking reasonable precautions when vehicle safety is uncertain.

Your use of Diagno does not transfer responsibility for operating or maintaining your vehicle to Diagno.

10. DO NOT USE DIAGNO WHILE DRIVING

Do not manually operate, type into, record through, read from, or otherwise interact with Diagno while actively operating a motor vehicle where doing so would be unsafe or unlawful.

Pull over and stop in a safe and lawful location before interacting with the application.

You are responsible for complying with distracted-driving and mobile-device laws applicable where you operate a vehicle.

11. ACCOUNTS AND SECURITY

Certain Diagno features require an account.

You are responsible for:

  • maintaining the confidentiality of your login credentials;
  • protecting access to your device and account;
  • providing accurate account information; and
  • notifying us if you reasonably believe your account has been compromised.

You may not access another person's account without authorization.

We may suspend or restrict accounts when reasonably necessary to protect users, prevent fraud, enforce these Terms, or comply with law.

12. SUBMITTED CONTENT

You retain ownership of content you submit to Diagno, including vehicle information, recordings, descriptions, and messages.

You grant Diagno a limited, non-exclusive, worldwide, royalty-free license to host, copy, transmit, process, and otherwise use submitted content only as reasonably necessary to provide, operate, secure, maintain, troubleshoot, and support the Services or comply with applicable law.

This license does not transfer ownership of your content to Diagno.

You represent that you have the right to submit content you provide.

You may not knowingly submit content that:

  • violates applicable law;
  • infringes another person's intellectual-property rights;
  • violates another person's privacy rights;
  • contains malicious software or code;
  • is submitted for fraudulent purposes; or
  • you are legally prohibited from providing.

13. AUDIO RECORDINGS AND OTHER PEOPLE

Vehicle sound recordings may unintentionally capture conversations or voices.

You are responsible for ensuring that your recording complies with applicable recording and privacy laws. Do not intentionally record private conversations through Diagno without any permission required by applicable law.

14. PRIVACY

Our collection, use, and disclosure of personal information is described in our Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference where permitted by applicable law.

15. DIAGNO PRO

Diagno may offer an auto-renewable subscription currently marketed as Diagno Pro.

The exact price, billing interval, included benefits, and applicable taxes are shown to you in the App Store purchase interface before you purchase.

Diagno Pro currently provides premium access that may include benefits such as access to diagnosis features, eligible diagnosis content, and AI Mechanic functionality as described in the app.

We may modify the features included with future subscription offerings, subject to applicable law and App Store requirements.

16. AUTOMATIC RENEWAL AND CANCELLATION

Diagno Pro is an Apple App Store auto-renewable subscription.

Payment is charged through your Apple Account.

Your subscription automatically renews unless auto-renewal is canceled through Apple before the end of the then-current subscription period. You can manage or cancel an active subscription through your Apple subscription settings.

Cancellation generally prevents future renewal and does not normally terminate access already paid for during the current subscription period.

Apple controls billing and subscription processing.

17. ONE DIAGNOSIS PURCHASE

Diagno may offer a non-subscription purchase currently marketed as One Diagnosis.

The price displayed by Apple at the time of purchase controls.

A completed One Diagnosis purchase is intended to unlock eligible paid content associated with the specific diagnosis for which the purchase was made.

It does not provide a Diagno Pro subscription or automatically unlock unrelated diagnoses.

Purchased access remains subject to:

  • account availability;
  • these Terms;
  • technical and security requirements;
  • fraud prevention;
  • applicable law; and
  • continued operation of the Services.

18. PURCHASE VERIFICATION AND RESTORATION

Diagno uses Apple and RevenueCat to verify purchase status and entitlements.

Temporary network, Apple, RevenueCat, or backend interruptions may delay purchase confirmation. If Apple completes a purchase but Diagno cannot immediately verify it, Diagno may retry or recover the transaction before initiating another purchase.

You should not intentionally purchase the same item repeatedly solely because verification is delayed.

Contact us at diagnosupport@gmail.com if a completed purchase does not provide expected access after reasonable recovery attempts.

19. REFUNDS

Apple processes purchases made through the iOS application.

Refund eligibility and refund decisions are generally subject to Apple's policies and applicable law.

Diagno does not control Apple's final decision regarding App Store refund requests.

Nothing in these Terms limits any refund, cancellation, or consumer right that cannot lawfully be limited.

20. PRICE AND SERVICE CHANGES

Prices and product offerings may change in the future.

Any applicable price change will be handled in accordance with Apple requirements and applicable law.

For active auto-renewable subscriptions, Apple may require notice or user consent for certain subscription price increases.

We may add, modify, or discontinue features, provided that we comply with applicable legal and contractual obligations.

21. ACCEPTABLE USE

You may not:

  • use Diagno for unlawful purposes;
  • attempt unauthorized access to our systems;
  • bypass purchase or entitlement controls;
  • interfere with service operation;
  • introduce malware or harmful code;
  • scrape or automatically extract content except where expressly permitted;
  • reverse engineer the Services except where applicable law expressly permits it;
  • impersonate another person;
  • use another person's account without permission;
  • use the Services to harm or defraud others;
  • resell access to Diagno without authorization; or
  • use Diagno in violation of third-party rights.

22. INTELLECTUAL PROPERTY

Except for user-submitted content, Diagno and its associated software, interface, graphics, mascot, logos, branding, designs, text, and other proprietary materials are owned by or licensed to Diagno and are protected by applicable intellectual-property laws.

These Terms do not grant you ownership of Diagno intellectual property.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for personal lawful purposes.

23. FEEDBACK

If you voluntarily provide ideas, suggestions, or feedback about Diagno, you grant us permission to use that feedback without restriction or obligation to compensate you.

This provision does not transfer ownership of unrelated content or personal information you submit through the Services.

24. THIRD-PARTY SERVICES

Diagno relies on third-party services, which may include Apple, Supabase, OpenAI, RevenueCat, Google, PostHog, and other infrastructure providers.

Third-party services may experience outages, errors, changes, or interruptions outside Diagno's control.

Your use of certain third-party functionality may also be subject to the provider's own terms and privacy policies.

25. SERVICE AVAILABILITY

We do not guarantee that Diagno will be available without interruption.

The Services may occasionally be unavailable because of:

  • maintenance;
  • software updates;
  • third-party outages;
  • network failures;
  • security incidents;
  • technical defects;
  • circumstances beyond our reasonable control; or
  • discontinuation of a feature or service.

We may modify or discontinue parts of the Services as permitted by applicable law.

26. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIAGNO DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE AUTOMOTIVE-SPECIFIC DISCLAIMERS ABOVE, WE DO NOT WARRANT THAT:

  • DIAGNO WILL ALWAYS BE AVAILABLE OR ERROR-FREE;
  • AI OUTPUT WILL BE ACCURATE, COMPLETE, OR APPROPRIATE;
  • A DIAGNOSIS WILL IDENTIFY THE ACTUAL VEHICLE PROBLEM;
  • DRIVING GUIDANCE WILL IDENTIFY EVERY SAFETY CONDITION;
  • COST ESTIMATES WILL MATCH ACTUAL REPAIR COST;
  • AI MECHANIC RESPONSES WILL BE CORRECT; OR
  • USE OF DIAGNO WILL PREVENT VEHICLE DAMAGE, BREAKDOWN, ACCIDENTS, OR INJURY.

Some jurisdictions do not allow exclusion of certain warranties, so some exclusions may not apply to you.

27. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIAGNO AND ITS OWNERS, AFFILIATES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR BUSINESS OPPORTUNITY ARISING OUT OF OR RELATING TO THE SERVICES.

To the maximum extent permitted by law, this includes losses relating to:

  • inaccurate or incomplete AI output;
  • reliance on diagnosis information;
  • vehicle damage or breakdown;
  • repair decisions;
  • cost estimates;
  • interruptions or loss of access;
  • third-party services; or
  • user-submitted inaccurate information.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIAGNO'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR

(B) USD $100.

These limitations do not apply to liability that cannot lawfully be limited or excluded.

Nothing in these Terms excludes liability for fraud, willful misconduct, gross negligence where exclusion is prohibited, or other liability that applicable law does not permit us to disclaim.

28. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Diagno and its owner, affiliates, contractors, and agents from third-party claims, losses, liabilities, and reasonable expenses arising from:

  • your unlawful use of the Services;
  • your violation of these Terms;
  • your violation of another person's rights;
  • content you unlawfully submit; or
  • fraud or intentional misconduct by you.

This provision does not require you to indemnify Diagno for conduct for which indemnification cannot lawfully be required.

29. TERMINATION

You may stop using Diagno at any time and may request deletion of your account through available account settings.

We may suspend or terminate access when reasonably necessary because of:

  • violation of these Terms;
  • fraud;
  • abuse;
  • security risk;
  • unlawful activity;
  • required legal compliance; or
  • material misuse of the Services.

Account deletion and subscription cancellation are separate actions.

Deleting your Diagno account does not automatically cancel an Apple subscription.

Terms which by their nature should survive termination—including intellectual-property, warranty, liability, and dispute provisions—will survive.

30. APPLE APP STORE

The Diagno iOS application is distributed through Apple's App Store.

The application is licensed, not sold.

Your use of the iOS application may also be subject to Apple's applicable App Store terms and Licensed Application End User License Agreement.

Apple's Standard EULA applies to App Store applications unless an applicable custom EULA governs the application license.

Apple is responsible for its App Store, Apple Account, payment, and related services, while Diagno remains responsible for the Services provided by Diagno.

31. EXPORT AND LEGAL COMPLIANCE

You may not use or export the Services in violation of applicable export-control, sanctions, or other applicable laws.

You represent that your use of Diagno is permitted under applicable law.

32. CHANGES TO THESE TERMS

We may update these Terms as Diagno changes.

The updated version will identify a revised Last Updated date.

Where appropriate or required, we may provide additional notice of material changes.

If applicable law requires affirmative agreement to a material change, we will obtain that agreement before the updated terms apply.

Otherwise, continued use after updated Terms become effective may constitute acceptance where permitted by law.

33. GOVERNING LAW

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules, except where applicable consumer law requires otherwise.

Nothing in this section eliminates rights you may have under mandatory laws applicable where you reside.

34. DISPUTES

Before initiating formal proceedings, you and Diagno agree to make a reasonable good-faith attempt to resolve the dispute informally.

Unless applicable law requires otherwise, disputes not resolved informally may be brought in a court of competent jurisdiction located in New York.

Arbitration

Diagno does not currently require mandatory binding arbitration under these Terms.

If we decide to add an arbitration agreement or class-action waiver in the future, it should be presented clearly and reviewed for compliance with applicable law before being imposed on users.

35. SEVERABILITY

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

36. NO WAIVER

Failure to enforce a provision of these Terms does not waive our right to enforce it later.

37. ASSIGNMENT

You may not transfer your rights under these Terms without our consent.

We may transfer these Terms in connection with a merger, acquisition, corporate restructuring, financing, or sale of all or part of the business, subject to applicable law.

38. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any applicable purchase disclosures presented within Diagno, constitute the agreement between you and Diagno concerning the Services.

Applicable Apple terms may separately govern the license to the iOS application.

USER ACKNOWLEDGMENT

Before creating an account or first using applicable Services, Diagno may require you to affirm:

☐ I confirm that I am at least 18 years old.

☐ I agree to the Diagno Terms of Use and acknowledge the Diagno Privacy Policy.

By affirmatively accepting these Terms, you acknowledge that:

  • Diagno uses artificial intelligence;
  • AI-generated diagnoses and responses may be wrong;
  • Diagno has not physically inspected your vehicle;
  • Diagno does not certify that your vehicle is safe to drive;
  • Driving Guidance is informational and not a safety certification;
  • confidence information does not guarantee diagnostic accuracy;
  • repair-cost estimates are not quotes;
  • AI Mechanic is not a human or certified mechanic;
  • you remain responsible for vehicle operation, inspection, maintenance, and repair decisions; and
  • safety-critical concerns should be evaluated by an appropriate qualified professional.
